Oregon Doctor Sues Over Blog, Twitter Posts
A doctor in Oregon filed a defamation lawsuit against a blogger over online comments she posted about his disciplinary record.
The $1 million suit, the first lawsuit in the state that involves Twitter, was filed by Dr. Jerrold Darm in July against blogger Tiffany Craig of Portland.
Darm alleges that Craig posted to her blog and tweeted about "ubiquitous" ads for his clinic in June and mentioned a 2001 reprimand Darm received due to an "inappropriate boundary violation with a patient."
Although the reprimand did not involve actual sexual misconduct, Darm was ordered to have chaperons present in the examination room when he saw female patients up until 2009.
According to a recent court ruling, the lawsuit may qualify as a Strategic Lawsuit Against Public Participation, which the state legislature has attempted to limit in order to prevent plaintiffs from filing defamation claims in order to curb legitimate public commentary.
Darm's lawyer must prove his defamation claim is legitimate in a hearing scheduled for October 20.
